These Terms & Conditions (“Terms”) govern your use of the Scape-Ops platform at scape-ops.com and the SMS messaging program operated by Scape-Ops LLC (“Scape-Ops,” “we,” “us,” or “our”). By using the platform or replying to a Scape-Ops SMS message, you agree to these Terms.

These Terms work alongside our Privacy policy, which describes how we collect, use, and protect your information.

Program name: Scape-Ops Project Communication

Program description: Scape-Ops is a project management platform used by landscaping companies to manage their work. The Scape-Ops Project Communication program lets each landscaping company exchange text messages and phone calls with their property-owner clients about a specific landscaping project. Messages may include schedule confirmations, progress updates, photos of work completed, requests for information, quote and change-order notices, and replies to questions you send.

Messages are sent only in connection with an active project between you and a Scape-Ops customer landscaping company. We do not use this program for marketing or promotional purposes.

You receive text messages from this program only after you agree to them, in one of these ways:

• Consent checkbox. In your client portal, or when you accept a proposal, you check the optional box labeled “Yes, text me about my project.” The box is never pre-checked, and you do not have to check it to sign a contract, accept a proposal, or make a payment.
• You text first. You send a text message to your project’s phone number. We reply only about that project.

You can withdraw your consent at any time by replying STOP.

Message frequency varies. You will only receive messages in response to your own messages, or when there is activity on your project that requires your attention. A typical project may involve a handful of messages per week during active work phases and very few messages outside of those phases.

Message and data rates may apply. Standard message and data rates from your wireless carrier may apply to each message you send and receive. Scape-Ops and the landscaping company you are working with do not charge you for these messages, but your carrier may. Contact your wireless carrier for details about your specific plan.

To get help with the SMS program at any time, reply HELP to any message you receive from a Scape-Ops project phone number, or contact us directly at privacy@scape-ops.com.

To opt out of further messages at any time, reply STOP to any message you receive from a Scape-Ops project phone number. After you reply STOP, you will receive one message confirming that you have opted out, and no further text messages from that number. To start receiving messages again, reply START to the same number.

Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to your wireless carrier’s network and is not guaranteed.

The Scape-Ops Project Communication program is available on most major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.

The platform and the SMS program are intended for use by landscaping companies and their clients in connection with landscaping projects. By using the service you confirm that:

• You are at least 18 years old, or you are using the service with the permission of a parent or legal guardian.
• The phone number you are texting from belongs to you, or you have the account holder's permission to use it.
• You will not use the service to send unlawful, abusive, harassing, or fraudulent content.
• You will not attempt to interfere with, disrupt, or gain unauthorized access to the service.

The platform and the SMS program are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Scape-Ops LLC disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

To the fullest extent permitted by law, Scape-Ops LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of, or inability to use, the platform or the SMS program.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the platform or the SMS program after an update constitutes acceptance of the revised Terms.
